Welcome to SWARM for Kids, a real-time, voice-based learning platform designed to make education engaging, safe, and personalized for children. These Terms and Conditions (“Terms”) govern your use of the SWARM for Kids app (“App”, “we”, “our”, “us”), operated by SWARM LTD. By accessing or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, discontinue use immediately.
1. Eligibility and Parental Consent
The App is intended for children under:
13 years old (United States, COPPA), or
16 years old (European Union, GDPR-K).
We require verifiable parental consent before collecting or processing any personal data from a child. Parents or legal guardians:
Must create and manage their child’s account.
Can review, update, or delete their child’s data anytime by emailing privacy@swarm.kids.
By registering, parents confirm they are the lawful guardian and consent to the App’s data practices.
2. Use of the App
The App allows children to:
Learn through interactive, real-time voice lessons.
Track progress, streaks, and achievements.
Engage with AI tutors in a safe, controlled environment.
Users must:
Use the App only for educational purposes.
Not upload or share inappropriate content.
Not attempt to access, copy, or disrupt App services. We may suspend or terminate accounts that violate these Terms or legal obligations.
3. Data Protection and Privacy
We adhere to GDPR-K and COPPA to ensure full protection of children’s data.
3.1. Data We Collect
We may collect:
Child data: first name or nickname, age range, language preference.
Parent/guardian data: name, email, billing details (if applicable).
Learning data: lesson progress, scores, XP, and engagement patterns.
Voice data: real-time voice input processed for lesson delivery (not stored unless parental consent is explicitly provided).
Device data: type, system info, session logs, and anonymized IP.
We never collect precise geolocation or unnecessary identifiers.
3.2. Purpose of Processing
We process data to:
Deliver and personalize educational experiences.
Track and display progress.
Improve system performance and safety.
Comply with legal requirements.
3.3. Infrastructure and Security
All data is hosted and processed on Microsoft Azure and Supabase, both of which provide enterprise-grade security and compliance frameworks.
Primary Hosting: Microsoft Azure
Encryption in transit (TLS 1.3) and at rest (AES-256).
Regional data hosting within the EU to ensure GDPR compliance.
Access control through Azure Active Directory (AAD) and role-based permissions.
Key management handled via Azure Key Vault.
Audit logging and continuous vulnerability management under ISO 27001 and SOC 2 certification.
Database and API Layer: Supabase
Used as a managed PostgreSQL database and API layer for structured data.
All connections secured with TLS 1.3 and row-level security (RLS).
Role-based access control (RBAC) ensures children’s data is isolated per account
Automatic backups encrypted with AES-256 and stored in EU regions.
Supabase complies with GDPR, CCPA, and SOC 2 Type II standards.
Analytics: Mixpanel
Used for privacy-preserving analytics to understand feature usage and improve learning outcomes.
Data sent to Mixpanel is pseudonymized, containing no personal identifiers or child-specific voice data.
Mixpanel operates under a Data Processing Agreement (DPA) and Standard Contractual Clauses (SCCs) for GDPR compliance.
Notifications: Novu
Used for real-time in-app and email notifications such as progress updates, streak alerts, or parental summaries.
Novu processes only event metadata (e.g., “lesson completed”, “new streak achieved”) and does not handle any personal or voice content.
Communication payloads are encrypted and transmitted securely via HTTPS/TLS 1.3.
Together, these platforms provide a secure, compliant, and redundant infrastructure that protects all user data in accordance with GDPR-K and COPPA.
3.4. Parental Rights
Parents or guardians may:
Access their child’s stored data.
Request correction or deletion.
Withdraw consent at any time.
Request confirmation of data deletion.

4. AI and Voice Interactions
The App uses AI-driven avatars and speech processing to guide lessons.
Voice data is processed in real time and discarded immediately after generating responses.
No conversations are shared, used for training, or exposed to third-party models.
Children cannot communicate with other users; all sessions occur in a closed, monitored environment.
5. Payments and Subscriptions
Some features may require a paid plan:
Payments are handled securely via Stripe or other verified processors.
Only verified parents or guardians may make purchases.
Subscription terms and cancellation options are shown before checkout.
Cancellations take effect at the end of the current billing period.
6. Content and Intellectual Property
All educational materials, character designs, and AI voices are the intellectual property of SWARM LTD or its licensors.
You receive a limited, non-transferable license to use the App for non-commercial, educational purposes only.
7. Termination
We may suspend or terminate accounts that:
Violate these Terms or laws.
Provide false information or fail to maintain parental consent.
Engage in misuse or abuse of the App.
Upon termination, all related data will be permanently deleted in accordance with our retention and legal obligations.
8. Liability Disclaimer
SWARM for Kids is an educational tool meant to supplement learning.
We are not liable for indirect, incidental, or consequential damages resulting from use of the App or temporary service interruptions.
9. Changes to These Terms
We may update these Terms from time to time.
Parents will receive notice via email and in-app notification before significant updates take effect.
Continued use of the App after notification implies acceptance of the revised Terms.
